MS Files Final Papers in Antitrust Case
By Aaron Dobbins | Published January 29, 2001, 1:37 PM
Microsoft today filed its final papers in the antitrust case it has been battling for over a year now. The 75 page document shared feelings that the Department of Justice's final report conceeds that a majority of the Redmond Giant's acts were lawful, and that whatever might remain as "unlawful" is not enough to invoke the Sherman Antitrust Act. Oral arguments are set to begin at the end of February, according to the Reuters report.

|You're all using Windows to post these messages anyways. Shut up with the 'Sue Microsoft', 'Removie IE!' and 'Microsoft made me cry' comments and move on. Like almost anything else in this world if you don't like it then DON'T USE IT! There are plenty of alternatives to the Windows OS' and most of the software that runs on Windows. Move on people. Quit whining. If you dont like it, dont use it.

|here here! Finally someone with brains. No one has put a gun to your head to use this operating system, but you continue to complain about whatever you can think of that might be wrong with this os. I say if you don't like it, don't use it. Find something else, or maybe realize that windows 98 isn't that bad of a product. I mean 85% + use this OS, I don't see alot of complaints, what I see is people wanting the latest in MS technology more and more. Anyways I've gotten off topic, again, don't like, don't use it. Bye

|The real thing that keeps people bundled to Windows is the games. While every other operating system has decent alternatives to office software, databases, servers, and the like (and quite often, *better* alternatives), an awful lot of people (myself included) are tied into Windows because game developers so rarely make their games cross-platform. I'd ditch Windows in a heartbeat if I knew that WINE would run my games with acceptable speed or if I could afford a G4 with an OrangeMicro PC card (since Virtual PC isn't fast enough). But, as long as the games I want to play are only developed for one operating system, I have to keep a copy of that operating system.

|Strange, how MS claims that IE is unremovable from Windows. They wanted the court to believe "Remove IE, and damage Windows". It's known among the more tech-minded of us that IE -can- be removed from Windows without damaging it. That was a part of MS's arguments in this case. They lied in a court case.
Whistler will have more tightly-integrated IE into the operating system. This, in spite of their recent court battlings in which the integration was a major concern. How could competing browser creators compete? They don't stand a chance, considering most home users are too lazy or too unconcerned to grab a different browser than what comes installed with their machine. "Control the only O/S, and control the world!"
They have constantly maintained that their business tactics were perfectly legitimate. Using backstabbing, underhanded tactics, the opponents products such as Caldera's DR-DOS were viewed by the public as inferior and bug-riddled. Quotes from BG himself acknoledged that DR-DOS was a superior product than his own. By using tactics that frightening the public, DR-DOS died. Caldera won a settlement for this, out of court, and out of the public view.
So, they stopped competing browsers. They stopped competing operating systems. They assuredly stopped countless advances in hardware because it might compete with their own business (i.e. bottom-line).
They have worked themselves into a position where they can manipulate software vendors so that if they sell a non-MS operating system, the vendor gets charged extra. Naturally, these vendors shut out the competitors products.
Is it any wonder why the only remotely viable alternative to Windows on a x86 platform is an untouchable, free, open source o/s? Untouchable, that is, to MS's previous record of business. No, it is not because nobody has tried to create a better alternative, but because when they do, they find themselves looking down the long, huge barrel known as MS. Step in their way, and get squashed like the bug you are! Either that, or get bought out by MS. After all, I'm sure they can very much afford to buy out opposing companies.
Monopoly? Of course not.

|Or perhaps you are just horribly mis-informed. The Netscape browser is about to get an additional 30 million users. Do you actaully keep up with the news? AOL is releasing the Netscape browser as the AOL Browser. This reduces Microsoft's 50% share of the browser market down to more like 30% with Netscape having over 60%. According to you Netscape has been 'Stopped.' I guess a better than 60% market share is crushed. Poor, poor Netscape...
DR-DOS doesn't matter because it does not ship with GEM. Nobody but *nix heads want a command line interface.
Microsoft has done nothing wrong but the DOJ beleived what Sun told them. I bet you worship McNealy and Ellison. Well bow down to your mentors. You have clearly been listening to them and you have clearly accepted anything they tell you as gospel. Poor misguided one.

|IE *cannot* be removed from Windows without damaging it. Windows' own help system cannot function without the IE engine, and many third-party programs that incorporate the IE engine won't function without it.

|Netscape is about to get more users. That must mean Microsofts legal agreement with AOL to solely distribute IE with their service is almost over. Good for them. It's a shame that Netscape is basically Mozilla with a different name, using a build from ages ago. Netscape does nothing but bloat the mozilla browser and call it theirs, and bundle other utilities that they bought with it.
You've brought up another interesting tale! The killing of GEM. Thanks! And that still does not help MS's case. They promised a far superior gui than this GEM to be released very soon (at the time), and later delivered a steaming plate full of crap! Naturally people waited for this fantastic gui instead of buying this GEM, and so it also died.
This is a very informative link, for you pro-MS people. I do strongly suggest you read about Microsoft's past practices before you glorify them.

Honestly, I have no idea who this McNealy or Ellison is, but I'm assuming they are high-execs or even owners of Sun. I cannot recall even a single word they have said, if I have heard them speak at all. Your strong accusations are extremely insulting, and you should choose what you write a little more carefully in the future.
As for the rest of you "Don't use it, use your BeOS/Linux/OS2" people, believe me, if it was a viable alternative, I would be using them. The fact remains that I have no choice then use Windows, ever since MS had eliminated all competition in the o/s market for the typical home user a long time ago.
And I should have said "de-integrate" instead of "remove", my mistake. This debate already took place elsewhere.

|Have you been in a time warp or something? I hate to tell you but the last study I read by zona research said that MS market share in the browser market is somewhere in the high 70's. That was before Ns 6 and based upon the reviews I don't think too many people have converted over to Netscape from IE. Unless Aol makes Netscape their default browser within the next six months the chances of Netscape being able to keep their market share in double digits is pretty slim.
If you don't realize that a pretty substantial majority of computers on the internet are using IE exclusively you must not be reading any of the studies done in the last year on browser usage.

|Well put, but I think we have to work on promoting and saising funding for new operating systems. I thin that if Mac carefully markets it's new OS it could attract wide number of users and I have heard rumors that OSX will be comming to PC! The new Mac OS is very stylish and easy to use, plus it is based on the stable BSD operating system, these factors could make it ideal for the home market.
I think too that MS has acted unlawfully and should be sued for this. We also have to show MS it is gonna have to work hard for the top spot and that it could all so easily fall off it's perch!

|Okat this whole MS thing is just annoying. I do think MS acted illegaly, unethically and quite honestly like any other American company. Further, any drastic changes to MS would kill the progress that is being made on the PC. I hate MS software (Windows mostly), but if the company were to be split right now, many home users would be in a very bad place. Sys Admins have many options, but right now the typical home user has no idea how to setup a Linux box or is weary of going to Mac. I use all three systems and truly believe that the home user will struggle if they do not have MS to carry them along.
