Virginia Sentences Spammer to 9 Years
By Nate Mook | Published November 4, 2004, 10:20 AM
A North Carolina man has become the latest example of Virginia's crackdown on spam, after being found guilting for sending hundreds of thousands of unwanted advertising e-mails. Jeremy Jaynes, considered one of the top ten spammers in the world by Spamhaus, was sentenced to nine years in prison. "This is a major victory for Virginians and all Americans," said Virginia Attorney General Jerry Kilgore in a statement.
Thank god. Hopefully this will deter other spammers and hope they all suffer the same fate. Their penalty of no internet access for 9 years isn't justified enough. We need to enforce this as a law in all states/countries. Stupid spammers!!

|If the amount of money involved even approaches the estimates, then the sentence is just and fair. When will the issue of corporate spamming be addressed?

this page clears up a lot of what wasn't said, maybe he deserves that 9 years after reading that?

|How can we judge the sentence without knowing the details. 9 years may seem like much, but think of this...
This guy was listed as one of the top 10 spammers in the world. This means he was sending an amazing amount of spam, and not only that, he was probably making hundreds of thousands of dollars doing so. I'm sure he wasn't just doing it for fun.
Given that, we still can't judge whether that was fair or not without the full details of what he did.

|I think this is a good example of spam laws being tested. I think 9 years is fair. I don’t want the spam to be in my inbox and this is a good place to start.

|They are making an example out of him. 9 years for a non violent crime is crazy. I hope it gets reduced in the appeals circuit. He certainly deserves jail time and a healthy fine. But 9 years...absurd.

|So what sentence will be given to a serious criminal? 4000 years......... the judge needs to get real......... hit their $$$$$ make em pay.... not make state pay to keep them....... Duh!!!

|OK, I'm all for putting spammers in their place (be that jail, OK by me) but 9 years is more than the minimum sentence for actual crimes against people (rather than bandwidth), like rape and robbery...
Let's be real here.

|Yes I take your point... sling them in jail for 9yrs and get them to pay for it! :)

|Hey, I mean, ok, spamming sucks and those spammers should get some sort of treatment. But putting someone into prison for 9 years (nine years!) because he sent out spam mails is insane. Sick. American. Dang I hope this country is coming to a rest one day.

|I'm not too familiar with criminal justice in Virginia but it wouldn't surprise me if this guy doesn't serve the full sentence. To the point of the previous post regarding the sentence being harsh I would have to respond in saying that the article states that he sent hundreds of thousands of pieces of spam. The dollar value of the bandwidth and lost productivity this guy probably cost his victims is probably in tens of thousands of dollars easily. 9 years is probably on the harsh side but anybody who sends that much junk deserves to spend some time in prison.

|based on the volume of email he likely sent out i doubt it's unreasonable. further, i wouldn't be surprised if there was a nice fraud charge in there as well.

|So 9 years is too much huh? Are you aware that over 60% of internet traffic is spam? All the servers and circuits in the world have to be equipted to handle all the internet traffic. How much money would you like to spend so that people stealing from you can get their traffic through? YES! Stealing bandwidth is just as bad as taking money right out of our pockets. I run a small server out of my house and I have spent over $2000 on circuits, spam filters, virus software and lets not forget the firewalls. I couldn't imagine how much big companies and isp's spend on such software and hardware.

|it's NOT 60% of the internet traffic, it's 60% of email traffic, stupid. that difference may seem subtle to you, but let me tell you: it is a HUGE difference!

|Stupid? Blow me jerk off! No matter if its email traffic or internet traffic these people are stealing our bandwitdh and causing unneeded expenses to all. Lets not forget the hours we all spend searching through our spam mails in case the spam filter filtered out a real email. And I agree 9 years or more and total restitution.
