Microsoft Sued for Xbox 360 Problems

Microsoft has been sued by a Chicago man who bought the company's new Xbox 360 game console over alleged overheating and lockup issues. The suit, which asks for class-action status, accuses Microsoft of rushing to market a flawed system to ensure it beat competitors Sony and Nintendo to the punch.

According to Reuters, the suit seeks damages and litigation related expenses, as well as a replacement or recall of Xbox 360 consoles.

To its defense, Microsoft said the issues with the new console affect less than three percent of all units sold, which is lower than the average rate of defects for newly released electronics, according to analysts.

However, within days of the console's launch, complaints surfaced across the Web citing the problems listed in the lawsuit. According to Robert Byers, the man responsible for filing the suit, the power supply and CPU are prone to overheating, thus causing the lockup problems.

Posts on gaming sites indicate the problems occur during regular use and also while logged into the Xbox Live online gaming service. The errors appear on a black screen listing several error messages, affected gamers have reported.

"It's my understanding that Microsoft hasn't acknowledged a major problem, and I would say that it's just too early to tell if there really is one," explained Jupiter Research senior analyst Joe Wilcox. "Not that it matters. The perception of a problem is serious enough for Microsoft to swiftly act to mollify early Xbox 360 users."

According to Wilcox, Microsoft "confirmed a liberal repair policy, for which the company will pay overnight shipping both ways."

I am now sure bill gates and the whole microsoft team are complete Di**heads and cant make quality equipment.for starters i buy the 360 8mnths later its stuffed i send it away i cant wait so i go buy another one and sell the other to my mate.only to now see 5mnths later my new xbox is fu**ed what a load of Cr*p twice ive had the red rings of death i shouldnt have even had them once.what compo do i get NONE i got nothing and this time im gonna ring the support team and abuse just abuse no listening just telling.Lieing bas****s told me the new ones dont stuff up well your wrong microsoft it stuffed up...Liars...

i hate xbox 360 u shell out over 300 to 400 of your hard eared summer job money an your 360 dies in the next month i send it in it takes over two weeks and i finally get it back and its fi..... i wish it had a damned letter saying my xbox has been tampered with i dont know what to do anymore i guess i will retire gaming forever at the age of 17........

Microsofts policy of the 3 year warranty for the x-box 360 is faulty in itsself! We tried to repair the x-box, before we knew about the blanket warranty! We found out sent it in... mind you it is only 9 months old... it was hipped back with a letter saying they would not fix it because it had been tampered with..
This is obscene and disgusting... We know have the option of shelling out money for another x-box.. Does anyone see the blatant injustice?

if your stupid enough to spend that much money on a video game, for your son, or for urself.. or let ur son work all summer only to blow 8 or 9 hundred friggin dollars on a game. Then i say it looks good on u.. A for all those who say, "Oh Microsoft, blah blah blah.." do u think any multi million dollar company gives a s*** if some of their customers have to buy a second or third product because of failure AFTER warranty is void. No, thats the way she ****in goes. For those who have spent over 1000 dollars on Xbox and Xbox 360 and ONLINE GAMING and Wireless this and High Def that, only for them to crap out and be returned, I point and laugh at you all. I have always been a faithful xbox fan but lately i feel like they really don't appreciate their customers.They have a take the money & run attitude. Every time i turn around they're charging us for something new. First of all its about 400+ dollars or even more when the console is released & those faithful gamers such as myself are the first in line to dish out the money. then there's the 50 bucks charge to have online access (ps2 had FREE online gaming) there are charges to get new maps for certain games, costumes, themes, among many other things. As a matter of fact there was a charge just to put armor on your horse in the oblivion game, wow you would think that a multi million corporation wouldn't be so hard up for money. The games range anywhere from $50-$90.We've had to buy extra accessories such as head phones and oh yeah, you can play a movie on the 360 but....you gotta buy a remote. Kinda like buying headphones for your kid on christmas but nothing to plug it into, very nice. With all of these charges you would think they would give you a break but no not microsoft. I had to send my original xbox in for repair & now i've had to send in my 360 in for repair TWICE. My 360 is now flashing red for a third time & when i called to complain they said that they did not have records of the second repair, how convenient! Anyway,they said that it would cost me about $140 bucks to repair. I would have to wait several days for the box to send it in to arrive & then wait several days for them to recieve it, several days for them to find out what's wrong then several days for them to send me back a REFURBISHED console that will also need to be sent back after some time. It almost seems like they do this on purpose & when i use the word several i mean " a long freakin' time" It's a shame that no matter how long we stand in line or no matter how much money we spend, microsoft's priority is to the almighty dollar, customer second. It's no wonder why in places like Japan, sales did not do well. They actually had enough intelligence to know & say, "i'm not dealing with that nonsense." We can spend thousands of dollars on the consoles,games & accessories but get nothing in return. You mean to tell me that we're willing to pay you, microsoft, hundreds of dollars on your product but when it dosen't work well because of the way YOU designed it, we DON'T have the right to own a new console but we must accept another refurbished one AND be charged an arm & a leg for it? Shame on you microsoft, I wish Bill Gates had enough guts to stand up & say " i stand behind my products & want only the best for my customers." A company w/ so much money does alot of charging to everyday hard working people who just want to enjoy gaming.Please i encourage everyone to call the FTC at 1-877-FTC HELP I want to try & contact the media about this because i feel like it's out of control & people are getting ripped off by these corporate bullies! MICROSOFT, ask not what your customers can do for you but what YOU can do for your customers!!

We were already sent 4 xbox 360 pieces of junk that ruined 17 games, Microsoft will not replace the games. Also they are sending out REFURBISHED XBOX 360 when you send them out for repair, but do not inform the consumer of this. The product is flawed and it appears that Miscosoft does not want to do anything about it. I filed a complaint with the FTC AT 1-877- FTC HELP
If enough people call and complain Micosoft will have to answer for what appears to be deceptive trade practices.

We bought our son a Xbox 360 for Christmas in Dec. of 2005. In Dec. of 2006, We Call Microsoft because of three flashing red lights. The console was sent for repair in mid Dec. of 2006. The first week of Jan. 2007, we recevied our console. Microsoft had replaced our old console with a new one. Now we have the same problem again with the console three flashing red lights. Microsoft wants us to pay $139 to repair it. I said, "that the console is only four month ago from the day that it was replaced". They said, "that the one year warranty that expired and that the replacement only had a 30 day warranty". Microsoft product is defection and Microsoft went us to pay for it. Something is wrong with this picture.

XBOX360 CRAP, my son is on his third one and now thats crashed , because he had brought the the first one 14 months ago and his last one was 7 months old MS said i had to pay , i said no way was i paying for a repair, and told them i would take them to court first before i payed a penny, thay changed there mind and now thats gone to be repaired.

my xbox 360 can play sometime up two 1 hour then over heats and most times it is about 30 mins befor it over heats i would like to know why it dose this. i have already baught the cooling fan that clips onto the back of the xbox 360 and it still dose the same fing the light gose red on the front of my xbox could some 1 plz tell me what 1 could do to prevent this happining

My x box 360 quit the second day, (It's possible I think because it was sitting next to a satellite reciever, but can't be for sure) took it to K-mart for a new one. Second one I put in a different room on a sturdy table by itself, works fine SO FAR, I have purchased a $60.00 warranty for 2 years that makes me feel pretty good. It has froze up once, but I restarted it and it's fine. I'm keeping my fingers crossed that there are no more problems with this system. I feel Microsoft should stand behind their products. It's December 2006, I hope things will get better with the company.

I am so upset for my son. He spent his entire summer savings on this 360 five months ago and we just got the 3 red light, kiss of death, 2 days ago. Same story as everyone else, warranty is up, send 140 dollars and they will attempt to fix it. I had no idea Microsoft didnt back their products better. After reading countless bad reviews I dont think I will even bother trying to fix it. All tallied its about a 800 dollar hunk of junk. Worse than that, is a disappointed 11 year old who worked so hard only to be burned.

I bought my son an XBOX360 in July and it has always frozen up during play and just recently it gave us the 3 Red Light Death. I am finding out that alot of people are having the same problem. It is a shame that Bill Gates rushed this on to the market when it was not ready. His original XBOX worked fantastic without any problems. At this point I do not even want a replacement unit. Just give me back my money.

I got my 360 on the release date and got a couple of the release games with it. The first thing I noticed was that my ESPN hockey game would freeze when I scored a goal. It wasn't a real problem since it unfreezed and I could still finish the game. But then one day it froze and I lost every piece of saved data for that game. The next game to cause me grief was ESPN baseball, it would freeze whenever the hell it wanted to. I thought it was a game problem since it was only the ESPN games that were freezing. But then I noticed that my dvd's would freeze as well, but only when I would fast forward and then hit play. I was begining to get frustrated so I contacted Microsoft and they told me some b.s. way to clean my cache and I did it and it didn't work but I didn't tell them. Well, about 3 or 4 weeks ago it started crashing big time, I would be playing a game and it would freeze before I could play anything and one time it froze before the dashboard could even come up. So I called them back and they thought it might be my hard drive, so we troubleshooted and my 360 didn't freeze (at first) when the hard drive was off, so they said they would send me a new one. Literally 3 minutes after I got off the phone my broter and I wanted to play a game of NCAA Football, so I left the hard drive off and we started playing and it froze on the opening kick off. Crap. So I called them back and told them and they asked me if I have ever seen the fabled 3 blinking red lights of death. I hadn't so they said that since they already had a service request for the new hard drive to go ahead and wait it out and try the new hard drive. Well it still froze, so I called them back and we were going through all the troubleshooting crap again when lo and behold I got the 3 blinking red lights of death. Damnit. So they sent me a new one free of charge, f'n a I was thinking to myself. Well I popped in a dvd I had just bought and I got a message on my 360 that said "regoin code does not match the system" and I was thinking "what the hell are you talking about I didn't buy this damn thing in Korea I bought it at freakin' Best Buy! I figured it was the disc so I tried another dvd, same thing. Games played fine on it, no complaints there, so I figured it work itself out. No dice, so I called them back again and told them what was going on and they asked me to play cd on it, the cd played fine as well as all the dvd's I tried. So they said that there must be something wrong with the laser that reads the discs. I'm sending off my new 360 today to get repaired or replaced which ever one they decide. Send up a prayer for me.

I had my xbox for 4 months and i didnt even play it that much and its broke now sitting there. I had just bought a brand new game and now i cant even play it. It really makes me mad that i buy something from the usa and it dont work. So much for buying things from you own country. I never had any problems with my old xbox and i played it all the time for about 4 1/2 years. It makes me really mad that bill gates has BILLIONS of dollars and cant put a year warranty on something that cost a lot of money. So now i get to sit there and look at my xbox and games worth about 700 dollars. I will never ever buy anything from that neird again.

I Purchased My 360 April 2006. It is for some reason hard to beleive that after all the times I spoke-up for the 360 against those folks waiting for the PS3 And the Wii that I have to do this. I am so upset!!!! I got the "three red lite ring of death." You see... I have just recently learned that phrase witch is now all over the internet. When My xbox 360 died I called support and found out (as many have) about the $139 I must pay to fix a five month old system. This caused me to investigate and what I found was in my opion a sea of disapointment for many who bought a faulty system that rears it head only after 90 day warranties are gone. I was going to spend the extra money to get it fixed but after the $1200 dollar spent on the system, extra controllers, games and reading complaint after complaint with more than 90% being the very same problems....I just can't do it....I don't want to waist another dime. I mean even the so called fixed, referbished or replaced systems are having the same problems all over again. What upsets me the most is Microsoft is down playing it using the numbers game...saying its ONLY 3%. Well 3% percent of 1,000,000 sold by the time I bought my system is 30,000. Thats alot of unsatisfied people having the same exact problem. Somthing is very wrong. I don't have the money nor the patients to continue beleiving that Microsoft will finally do the right thing and adress the problems (bad design promoting heat issues) making it worth fixing. Paying more money for somthing that seems to be for now a continueing problem is a lost cause. Replacing someone elses system with another previously dead system that is only going to have a repeated bad performance is stupid. They should be giving all of us Brand new system so us 3%'ers can have the good experience that the other 97% is aparently are having. Gears of war is coming out soon too. Shame on you Microsoft. Other companies would have had a recall of some sort. I feel robbed. If it is such a small problem only effecting a small number of us than give us a new replacment that works!!! I here there is a new version comming early next year that runs cooler therefore more stable. Hook us up with that one. Some people only take you seriousely if you speak-up. We all need to speak-up in one voice and make it right for all of us. For me its not just about money. Im a gamer and this sucks.

I purchased a 360 this summer and it crashed a few months later (prior to the warranty expiring). They sent me a box and I received a "replacement" with 2 weeks. The replacement has now crashed (3 red lights) just a few weeks after arrival. Thankfully I purchased an extended waranty this time. Microsoft is sending me yet another box to send my 360 in for "repairs". What infurriates me is the fact that they would have expected me to pay $129 for the repairs had I not purchased the warranty. Maybe the third time is acharm. I just seriously doubt that I will ever buy another Microsoft console seeing that I've had both the PS1 & PS2 without any problems ever.

ive had my console 2 weeks now it wont read discs, i tried to call microsoft only to be put on hold for up to 45 mins on one occasion. when i did get through i tried to make a complaint only to have the phone put down on me by some arrogant fool. its now 6 weeks on and i have got nowhere

I have contacted over 3 seperate legal groups who want to deal with this matter. Enough is enough, lets take this evil corperation down. Oh yeah and half you morons dont realize, YOUR SYSTEM IS MADE TO BREAK,itll just happen after you warranty is up that way Microsoft doesn lose money. Its probably 3 percent work more like it. I live on long Island, NYC, I know over 1000 people. The percentage of people i know who have not had this problem is slim. 1 friend of mine out of the 10 of us who bought it had no problems. To me thats 90 percent of the pople i know hvae this problem. If you live in bumble **** you probably are sheltered. ANd one of you said microsofts other systems, they had ONE. They make software not computers. If dell or gateway made 360 you wouldnt have this problem. Microsoft knows nothing about building anything

Because they dont have the product line or facotories to support the mass productions like sony or Nintendo. And My ps2 broke but when sony replcaed mine atleast it worked, took them a while to get the kinks out but atleast they admitted they were wrong. And I NEVER HAD A PROBLEM WITH ANY NINTENDO SYSTEM EVER. Still have my original from 85
Why is this , cause they soley make games and thats all they do. Unlike microsoft who was just trying to make a buck and now al theyre trying to do is make sure they dont lose money and thats it- This system wil flop a year from now

If any of you want to be part of a class action suit go to www.lawyersandsettlements.com and click x box 360 in the search. You can then file your comlaint there and they will add you with the growing number of complaints. It is advised that you also find your own consul to avoid getting barred by the statue of limitations.

Thats not fair, i spent over 1000 dollars on this thing. I had the three red light problem back in May, took over a month to get it back. Not only did I not get a new console but they sent me someone elses, so I waited all that time and they didnt even fix my console. Now this one is freezing all the time, I cant even play it. I called up demanding that I get sent one over night so I ddont waste another month of Xbox live member ship, but they refused to put me through to someone to accomidate me.[According to Wilcox, Microsoft "confirmed a liberal repair policy, for which the company will pay overnight shipping both ways."] How can I get this done, the customer support told me they cant do that. Can someone help me or atleast tell me who wants to file a class action suit? Theres no reason for something that costs this much to break this early in its use. I had a 500 dollar printer from epson, it broke they sent me a new one within 3 days. How the hell does micorsoft,one of the most profitable companies in the world, who state that its only 3 pecent of consoles whic is a lie, can get off by cheapin out the customer and making them wait over 30 days to recieve it back. I think this is a scam, they'll probably all break within the times of the warranties exspiring-

I am going onto my 4th 360 since release!!!! Thats 10 months!!!!! A new one every 2-3 mos and I only really play 2 or three times a week!!!! Stupid microsoft says it is an isolated incident, hardly everyone of my friends with the exception of one mind you it is still 4 out of 5 that have fried!!!! 9 freekin 360's for 4 people!!!! Its a DAMN JOKE you cant play for long, it freezes,crshes or just doesnt respond!!!! NO QUALITY.....I have and still play my original nintendo 20 years later with les problems than a 360 fresh out the box!!!!!!!!!!! Microsoft should take responsibility and by me a PS3!!!!!!!!!! Im so fed up with there products with the bugs and problems Im switching to a mac OS....Thanks for nothing but problems and hassles BILL GATES!!!!You should be sent to jail for robbing millions of people with faulty products!!!!!!THANKS FOR NOTHING!!!!!!!!!!!

How do I jump on the class-action suit against Microsoft (XBox 360). Ours keeps overheating with red lights blinking and locking up. Microsoft has told me that I have to pay $129 dollars to have it fixed (with a 30 day warranty after that). That is riduculous!

My wife and I sat in line outside of a Target for 14 hours. It was cold, but we were excited. The most anticipated system was about to be released, or so we thought. Within the first month it started freezing up. As it locks up, all you can think is "When did I last save?"

Okay, fine. I called XBOX (Microsoft) and told them what was happening. "We'll send you a box to ship it in", they told me. Great, I sent it back. 2 1/2 weeks went by and finally, I got it back. They even sent me a new game (Kameo) so I was pretty good with the service. Happy as can be, I went to playing. (Withdrawels were setting in) Almost immediately, it started again. First it just locked up, then started blinking three red lights.

I searched online for fixes and tried everything. I placed a fan behind it, a fan in front of it to draw out the heat, placing it away from the TV, on top of its very own stand, etc. Nope. It would work enough to come on and get me excited that it was going to be okay, then checkerboards and lines filled my screen.

Again, I called XBOX (Microsoft) and again they sent me out a box. Again, they decided to send me a game (Kameo, again!) to make up for the problem. Four weeks went by and everytime I called, they'd say they already sent me a box to return it in. Finally, I received a box.

Then, we got it back. I enjoyed it for about a month, then it did it again. Lines, checkers, red lights on the power button, numerous calls to XBOX. They then try to tell me that my warranty is expired. What? 60 days? I didn't even get 60 days worth of playing because of the problems.

Finally, they decide to send another box. Again, it never came. I have to call again and again. 5 days later, I get the box. Great, I send it back again. 1 1/2 weeks later, I get it back. During this time, they send me an Intercooler. Plus, I had requested the new power cord and AV cable. I received them before I got the box to send it back in!

I just received it back (they tell me they sent me a replacement every time) and I played it for one day! Yes, I said ONE DAY!!! Remember, this time it had their Intercooler on it, the fans, its own separate shelf away from the TV, etc. Now, they tell me they don't think they can do anything for me because my warranty has expired. WTF? It has NEVER been right. I spoke to a supervisor and he says I have to wait 72 business hours or so for someone to get back to me. ( What's that? 1 1/2 weeks?)

All I want is a system that works. They keep sending me these "refurbished" systems and tell me that they are "Good as new." I am so fed up. For all these people that think a lawsuit is not in order, think again! I didn't jump to that. I gave them chances, over and over. I even asked that they just send me a coupon for a new system in one of the local stores or just for them to send a new one. Nope. It must be too much trouble to do that. Making a customer happy can't possibly be a priority. Now here I sit. Out of 6 months, I have had a system in my possession that is usable for maybe 2 1/2 months.

A die hard XBOX fan (mainly due to Halo) is thinking really hard about the new Playstation. I'm ready to say FU to Microsoft and scrap any hope of ever having a good system.

This is their last chance. Anyone else tired of giving them every chance in the world to make it right, just let me know. I'll be right there with ya!

To reply to most of your comments, i leveled with a supervisor. I said "If epson replaced my 400 dollar printer within 2 days of my complaint than how come Microsoft cant do the same thing. Why do they have to send me another broken system thats not even originally my system, this means your not even fixing them. Then I have the system and it breaks right away. Not to top that i have a year warranty, and most people dont. Theyre just trying to save money, not help the customer" And this guy said "Your right they do it probably to save money" The supervisors lie, they tell me that they only have the option of a 15 business day delivry. mean whil half of you said you got yours back within a week or less but you had to pay for the repair which is fubar. I got a 1 yr warranty in the box, how did all of you get less of a warranty than that?? I waited over a month to go through the process last time. My advice to all of you, this is the LARGEST CORPERATE SCAM EVER, obviously none of the systems are good. Eventually everyones system will crash rt after the warranty is up that way microsoft doesnt lose anything on the system. At this pt theyre just trying to screw all of us. Lets put them in thier place and SUE!!!!!!!!!!!!!!!!!!!

I HAVE ALWAYS OWNED PLAYSTATIONS, AND NEVER HAD ANY PROBLEMS WITH IT. I TOLD MY FRIEND WHO IS A HUGE XBOX FAN THAT I WOULD NEVER GO TO XBOX. AFTER HE GOT THE XBOX 360 IN FEB OF THIS YEAR , I SAW THE GRAPHICS AND WANTED ONE. I GOT ONE THE FOLLOWING MONTH, AND TO MY SURPRISE I COULDNT EVEN GET PAST THE THIRD QUARTER WITH LOCKING UP. I RETURNED THE GAME THINKING IT WAS JUST THE GAME. NIEVE IN MY OWN THOUGHTS , I THOUGHT THERE WAS NO WAY A PROBLEM COULD BE WITH THE XBOX, SINCE LIKE I SAID NEVER SAW A PROBLEM WITH PLAYSTATION. AFTER RETURNING MADDEN 2 MORE TIMES I CALLED THE NUMBER ON THE XBOX BOX, AND THEY HAD NO HELP TO OFFER ME. THE WOMAN ON THE PHONE HAD NEVER EVEN HEARD OF MADDEN FOOTBALL ( ARE YOU KIDDING ME !!!??? ). SHE DID NOT OFFER FOR ME TO SEND IN THE BOX TO BE LOOKED AT, SHE SAID IT MUST BE THE GAME. I HAVE SINCE BOUGHT MLB 2K6 AND SURPRISE, SURPRISE LOCKING UP JUST LIKE MADDEN. MICROSOFT IS A WELL KNOWN COMPANY AND WELL RESPECTED IN THE ELECTRONIC BUSINESS, BUT SINCE I HAVE SEEN MY OWN PROBLEMS WITH THEM AND THE XBOX 360 I WOULD NEVER RECCOMEND TO ANYONE THAT I KNEW TO BUY AN XBOX 360, NOTHING BUT PROBLEMS, AND FINALLY, I JUST WANT TO SAY I CAN'T WAIT TILL PLAYSTATION 3 COMES OUT !!!! Bought a 360 the day after Christmas at Wal-Mart. Right away it would sometimes crash. Later it advanced to a point that the console does nothing but the flashing three red lights. I've tried every trouble shooting fix I can find but nothing makes any difference. I'm dealing with the support at Xbox- so far I recieved some kind of a form letter e-mail listing the very same fixes available to veiw on the Xbox website. I suspect I will need to send the thing to Xbox. I don't have a sales reciept to prove the date of my purchase, but I'm pretty sure I registered it with them not too long after purchase. I'm wondering if I am likely to get stuck with no warranty and high repair bills.

I started complaining a bit early. To update my last post, microsoft is being cool about my failed console. I'm past the 3 month warranty and have no sales reciept-still Xbox is sending a box. I'll get a repair, a refurbish, a new console, whatever-I don't care. I just want to play some of these kick a** new titles coming out.

How on earth did you get microsoft to replace your X-Box??? My boyfriend just called them and tried to have them help fix or replace it and they told him that since he was past the 3 month warrenty, he'd have to pay $130.00 to fix it or there was nothing else they can do. He even has a receipt and the box it came it. This is rediculous...you pay so much for the machine and he even waited outside for hours in the cold to get one and this is all the thanks he gets. This happen to anyone else??

I have had my Xbox 360 since November with no issues. It has locked 1 time but I think that it was because of me. I use it for DVD's and for games with no issues. I have owned PS2 and the original Xbox. I went through 3 PS2's and know a lot of other ppl that it stopped reading disks shortly after the 90 day warantee ran out. My Xbox had 1 issue. 360 no issues so far.. Look at computers which is what a game system has evolved into and that is why the problems as with a typical computer there are some issues. Basically as long as the software and hardware are built by a human they will have flaws.

I have had the console xbox360 since christmas and have not played it much then on the 25/02/06 i was on xbox live and the game started freezing therefor i had to reset the console but it would not load up and then it would load and the xbox symbol came up and froze all the lights were flashing red this repeatad for up to half an hour finally i got back on to my game and it froze again.
I have been in touch with microsoft and they said that it was a common fault with these machines, they have offered to fix it or replace it, but i had no oppology from them.the xbox360 is not a cheep machine and these problems should not be happening,even though they have offered to fix or replace it they said there is no guarantee that the next one wouldn't do the same.

Yes the 360 has some flaws.... any "launch" product is going to. The first one I got would only power up the video card output about 1/3 of the time that it was booted. Best-buy was happy to exchange it for me at no cost ie: Brand-New unit, no refurb!! I have noticed that it runs much more stable if used laying down, for what ever reason running it vertical seems to cause more lock-ups. Not to mention that it has left some marks on my games running it vertical (and no I DIDN'T change the position while it was running.... I did read the sticker on the drawer that said NOT to do that). For the most part this has been the best system by MS for gaming yet.

For you PS3 people....(And don't get me wrong, I LOVED my PS1 and still love my PS2). Do you know that Sony fired the entire team that was working on the PS3 because it over-heated so horribly that it caught fire! So if your wondering about the extended delay in release... there it is. The've gone back to square-one @ the drawing board! And yes they are trying VERY HARD to make the system so that it will burn the console's code into a game the first time it is inserted. This means that NO-ONE would be able to use ANYONE else's games. Honestly I don't believe that the USA is ready for blu-ray technology. So patiently wait for your new PS3 untill God knows when... In the mean time I'll be playing away on my 360 :)

I bought the premium xbox 360 package when it firt came out with in the first few minutes I turned it on and got a error message and red blinking lights on the power up button. I had thought it was just not hooked up right so i undid every thing and started it all over again. I then started it and it worked but with in about 5 minutes of playing the game i bought it froze up. I switched games and it froze again. I wasan;t sure what was going on so i never called or anything until i relized that other people were haveing the same problems as me. Finily I found a site and it had a customer support number and i called it. They said that my problem seems to be a hardware failer so they are paying the shipping to and back to either fix the problem or give me another one. They said that since the boot up error i keep getting witch is in many diffren't langueges and I get the red lights that are blinking that it is a hardware faliure. So I am haveing the same problems as the guy filing the lawsuite but i don;t think sueing has to be done becuase they are doing something to fix the problems at least they are not chargeing me like sony would. I have bought a ps2 and something was wrong with the lazer and I called sony and the said send it here and pay us x amount money(don;t remember the actual amount they wanted) and we will fix it.At leat microsoft customer support took less than 5 minutes to get to talk to a customer support rep and she was very nice. At least it wasan't like calling dell customer service line and getting a person from india that i coulden;t understand a word they were saying. Not that there is anything wrong with people from india doing cutomer service but It would be nice to talk to someone where i don;t have to either repet my self 100 times and or have to ask 100 times what the person said to me.

When I first got my Xbox (the original one), I played it for a year with no problems and then one day out of the blue it just froze and the light around the power button was orange instead of green. I knew this was because of overheating so I called Microsoft and they said for $99 (I bought it when it first came out so I paid $299 for it), they would fix it and ship it back to me within 4 to 6 weeks. Not wanting to wait that long, I took it apart and found that the problem was a cat hair was laid across the board and burnt out the exhaust fan so I connected the exhaust fan to the processor's fan and voila it worked for the next 3 1/2 years, it's just a little loud. So, the moral of the story is this....why would Microsoft make it next to impossible to open the xbox360 without special tools that you can't find at your local hardware store....think about it, there will be overheating and they will fix it, for now. All you hear about is how MS keeps losing money to produce these consoles so they have to make up for that in other ways.

I got my 360 on launch day and play it aprox 6 to 7 hours a day with no problems. I also have two friends with them and no problems so far. I got a PS2 and returned it twice before I got one that worked. All company's have problems but it's not as much as it seems. Most of the problems come from user ERROR (not venting it properly) or wana be gamers that only buy PlayStations. True hard core gammers use all systems and don't cry about little problems that come up.
THAT IS WHAT THE WARRANTY IS FOR. Nothing is perfect in Life if it was We wouldn't be here.

I bought the Premium 360 package on Christmas Eve along with 4 games. After playing for about 45 minutes, the unit quit working and my remotes were blinking. I called Microsoft and was informed that I have to send it in to either be replaced or repaired. Truly amazing!!

Most of these problems are from users who are experiencing them, which isnt really alot. It just seems that way because only the users who are having problems are rpoeting them. Millions of other users are not having any issues. You dont hear about them because they arent flocking to their computers to tell everyone their 360 is perfectly fine.......

Actually the MS customer service I spoke with actually said they have had many units returned for repair.

Also the liberal policy (glorified in the article) of MS paying for overnight shipping both ways is a joke. Yes they will ship both ways overnight, but not on weekends. Also why not just cross ship like most other manufacturers. I'll give them my CC # (just like i've done with WD, Maxtor, etc) and they can charge it if I dont send the defective unit back. I figure I paid for a $400 NEW Xbox and if its going to be DOA (or dead shortly after I turn it on) I should be entitled to a NEW Xbox not a refurbished one.

How many of you actually know alot about computers?? As I read most of the postings, I found it fairly evident that most do not know much about computers b/c if you did then you would know that, that's what the Xbox/Xbox 360 is, a smaller version of a computer!! No wonder they overheat, even though it's been found that the two different power cables that were made for them, the company that made one, is causing alot of the problems. As a new product like this comes out you have to expect problems to occur, especially when Microsoft pushed the 360 out so quick. And no I don't have my 360 yet but I'm 8th in line to get mine next(hopefully before the new year) but I have played COUNTLESS hours on a friend's and have run into several error messages.

For those of you out there that think PS3 will be better, you might want to think about that again!! If Sony has there way with PS3, then you will only be able to play the games YOU purchase!!! Yes you read that right, because Sony is working REAL HARD to implement serial coding into each game so that when you first put a new game into your PS3, it imprints part of the serial code into the hardware of the PS3 meaning that you won't be able to take that game to a friends house and play it on their PS3 and this would kill any used market for PS3 games!!! So for you hardcore PS users out there, you might want to think twice before putting tons of money into a PS3 (IF), but most likely, Sony gets their way and implements the serial coding into each game!!!

I also find it very hard to believe the graphics will be better on PS3. Yes you might have a few games that are graphically better on PS3 but the overall graphics on most games will not be better on PS3. Microsoft I believe has been and will always have the better graphics on their consoles for some time!

If you guys think that Microsoft, with all of their testing, didn't find know about this problem before they released their console prematurely then you need a lesson on economics. MS obviously wants to gain market share from Sony so they released a product that they knew was faulty because if they chose to fix it first, they would have had to wait until after Christmas and that would have meant fewer units sold. I read a comment in here that the guy who's suing is probably from Sony, I wouldn't doubt it. Sue MS to give their system bad publicity. This war over the video game console market involves a lot of money and we all know the extent that MS is willing to go to gain market share so why are we all content to just go along with the program. I didn't get a chance to buy an Xbox360 but if I spent 400 or more for it and a few days later it froze, I'd be pissed especially if they knew about it and it's naive to think that they didn't.

It's amazing what people fight for in life. Life is simpler than what people make it out to be. It can be much more wonderful if people actually fought for things of importance. We won’t really find out how many of these consoles are really bad until after Christmas when everyone opens and plays their XBOX. Of course this is about money and notoriety and nothing else. “Look at me I'm the man that took on MS.” Who cares! I'm quite sure he bought something in his lifetime that didn't work the way it was suppose to and returned it for his money back or got it repaired without resorting to suing. If he didn't get a warranty with his product then I stand behind him. No matter how much companies test a product they can't prepare for everything that is to come, hence that why warranties were created to protect the manufacture. For the companies that gets it right the first time great but for the ones that don't the consumer is the true quality and assurance tester. Everything that we buy legally has a manufacture's warranty coming with it, not to mention a return policy from the store. If your Xbox doesn't work use one of the two option stated above. Case closed and headache gone.

My husband got his xbox on a Tuesday and by Sunday it started freezing. We sent it back and they sent us a new one. We received a new one and when it arrived on Friday it worked but it froze once while my husband was online, and Sunday it froze up on me once. So we unplugged it and it worked. So today 12/13/2005 it froze, stopped in the middle of my game, and when I waited a few minutes and turned it back on, it came to a black screen. I am sending it in again to see what the problem is. If the same thing happens, I am going to get my money back. The system is not around anything, it is well ventilated, so I don't know why it keeps overheating or acting up.

In order to decide who's right in this case, MS or this guy, you have to think about what this lawsuit will accomplish. We are at the mercy of giant corporations everywhere. They control the TV networks, the newspapers and more facets of our lives than you would care to know. I doubt this guy wants to take this class action for personal monetary gain. A corporation is not human so the only way to hurt it is in the bottom line....money. I think this guy should be commended for going to bat for so many of us who don't have the cojones. MS did try to rush an inferior system to market before it was ready because they did want to beat the holiday season and their competitors and they should pay for it. Why should I have to send my brand new Xbox to be fixed only to get it back 2 months from now (after they have my money I might add) instead of just waiting until it's ready to be released. When is the right time to do something about it, when it starts overheating and catching fire and burns down people's houses. The point is, it's all about money nowadays with corporations and we're the ones paying so we should get what we pay for. MS knew there were potential problems with this system but they just wanted it out there for Christmas. We should be happy that we have a guy on our side. Remember Ford,they knew they had a problem with Pintos catching fire but it was more expensive to recall the vehicle and fix the part than it was to just settle the lawsuits brought on by people whose family members had died. That was until someone figured out what was going on and took Ford on head on and hit them hard in the place where it hurts corporations worst....the financial statement. Don't be so naive people.

I am sorry but I don't usually play video games but my husband and kids do, this is the second time that my xbox has froze and it was unplugged all night and on top of a table, no heat was getting too it and the next morning it I plugged it in and about 10 min. later it froze up. So does that mean that I am retard because it froze or is there a problem with my xbox. This is the second one we received and I am sending this one back if the next one freezes up I am getting my money back. I don't have a problem with xbox or its gaming system, but I dont think your comments are appropriate when it comes to other people's money and property.

Well alot has been said on this topic, so I don't want to repeat too much of what has already been posted. Granted, MS isn't my favorite software company, with its wonderful track record and great example as "leading" OS software and such (i love that Bill Gates demonstration with the blue screens and crashes of his products), but this lawsuit is outrageous.

I'm not an MS hater, a PS fanboy, an Xbox fanboy or anything. In fact, the only product I have related to those three is a PC running on XP Pro. I've had my fair shares of BSOD, crashes, freezes, but I don't jump the gun immediately and go sue them. NOTHING is perfect, you can expect pretty much anything to have some sort of problem: large or small or both. They have provided pretty quick service from what I've heard (I'm like many others that pre-ordered in the summer that are still waiting for their Xbox 360s) and free delivery. I'd take that anyday.

Yes, IMHO I do think the console was rushed for the holiday season, supply hasn't met demand, and the product is flawed, NOT defective (maybe some, not many cases, yet). As a consumer, yes, I'd be mad if my 300-400 dollar system crashes, but there are ways to fix these problems. If all your attempts to alleviate the problem don't work and you call the 800 number and they OFFER to fix it as quick as they can, what's your problem? Do you even realize that so many people out there that want the system so badly still don't have access to one?

Some companies tell you 2-4 or even 6-8 weeks for a repair or replacement, this is freakin overnight. Yes, they may have screwed up and sold alot of faulty systems, but they are attempting to fix it, and quickly to boot. And I think that about 50%, probably more, did not read the manual or just barely scan it, hell some probably didn't even open the plastic bag that it's probably housed in and went straight to plugging their console into a TV to start playing. In the end, that's consumer and manufacturer fault. Consumer side for not being responsible on your behalf (guides are there for a reason unless it's a half assed one that only states manufacturer name and product model, etc.) and manufacturer side, in this case, for not having a good standard for their product(s) (PSU and such). It's their responsibility, their name is on the product, no one's credibility is on the line except for them, for making poor judgement.

I've been in a car accident where my jaw was shattered and minor memory damage and had to wait 4 years to have it settled due to the other guy's insurance being stiff. Now that's pain and suffering and cause for a lawsuit. Suing because your game system isn't working when there are options to fix the problem, that's just an attempt to make money.

ohh im luky becouse i went and pre ordered at comet and they make a mess up and then said i wont have it till after christmas but lukely today they phoned back and said i will have it on thursday 21 and i am so glad i can finally play on it on christmas but i will have a quick go of it on thursday to see if it works i am so exited.

I don't know about you but I wouldnt want to buy a car then have to bring it into the shop a week later.

I cannot believe this stuff - in my part of the world (Australia), if a product of any kind is faulty, you simply take the 'beast' back to the retailer and either get a refund or exchange - the whole concept of getting all teary and weepy and starting a class action is absurd - Monty Python is an insufficient construct to deal with this sort of nonsense. How much economic waste (ie unproductive $$) do you think that wankers like this add to the manufacturing economy (and lawyers' bank accounts) of the world because of this type of nonsense?? Consumers need to 'get a life' - when did a bit of dodgy games software or a soft iPod nano screen cause the world to stop??

i agree with you fully and anyway microsoft did'nt no it at first i heard it has 1700 pieces no wonder there are mistakes microsoft are doing things free and he is taking advantage i hope microsoft sues him for wasting there time when they are doing everything in there power to stop the problems i am getting one on thursday 21 i cant wait.

Image yourself playing 48hrs non-stop, without saving (not sure if it has auto-save), and all of a sudden----it overheats and bsod.

The console would have gone out the window if I were to own one and have this problem.

Game manufactorers recommend frequent saving. Say, once every half hour.

BTW. 48 hours non-stop? Yikes. Do you want to kill yourself or something?

Take a break every hour for 15 minutes.

You'd have to be an idiot to think Microsoft would release anything without bugs, these days. Perhaps while we allow these lawsuits, we also need to classify these people as legally stupid. They clearly need protecting from themselves.
