Actually you are half right..
In criminal cases, the prosecution MUST turn over all exculpatory evidence to the Defense. If for some reason they don't and later it is proven they withheld they face disbarment and even criminal charges.
However this is a civil case, basically like was mentioned in the article, all evidence that will be used in court must be shared between the two camps prior to the hearing.

Its the same damn concept. If you are changing out or switching parts in your console, then basically its no longer that original console.
The argument of "Upgrading" Consoles is flawed. Because consoles sell so well and work so well because they are a closed system. Lets say for instance that the Xbox360 had an option to upgrade the video card in it....
So consumer has to fork down anywhere between 100-200 dollars for this "upgrade".
Now developers have to decide wether they want their games to be backwards compatible with the old video card or not... So they either alienate the install base, or suffer some extra financial burden and make it backwards compatible, or deliver a sega 32x blow to the peripheral and just ignore it.
The beauty about Consoles from the perspective of the developer is that they don't have to worry about compatibility, they have a target install base of x million people, by being a closed system you take out 1 huge variable which is compatibility.

This is quiet simple.. Apple PC pain in the arse to upgrade, PC not so much.....
This is the type of thing that is really hard to messure since I know there are alot of ppl who don't buy branded pcs from Dell/HP ect and rather build their own rigs... Im one of those spent 1500 last year for a PC equal to a 4k Dell pc and Im sure i dont appear in that statistic.

Wow talk about not understanding the news and doing little to NO RESEARCH!!!
First of all reports from lots of retailers across the US have said that they dried up on Premium and Elite packages(aka shortages on both those fronts) and only had Halo edition and Arcade SKUs. Although some went as far as to say they were totally sold out.
SECONDLY and MOST IMPORTANT. It is a known fact that Microsoft Stuffed the retail channels last year to meet the 10million projections they had, and had quiet a few retailers mad about that. So this year they went more conservative and held back on supplying that insane amount they did last year. What apparently they did not predict was that there would actually be a shortage of the Premiums and Elites during Christmas, had Microsoft supplied enough of these they might have outsold Nintendo during the month of December.
