Microsoft laughs off Apple legal request to kill TV ads

Apple is a company known for good design -- meaning also that appearances matter beyond just the products. Apple's legal department may have done something that appears simply laughable. Even if untrue, it's a helluva good story -- and a Microsoft executive tells it. Well.
Apple has a reputation for issuing legal take-down notices. The practice is a byproduct of the company's penchant for secrecy. Many Websites posting leaked Apple product pics have felt the burning ire of Apple lawyers. Today, at Microsoft's annual partner conference, COO Kevin Turner described receiving what could be characterized as the ultimate take-down notice.
"Two weeks ago we got a call from the Apple legal department saying, hey -- this is a true story -- saying, 'Hey, you need to stop running those ads, we lowered our prices.' They took like $100 off or something. It was the greatest single phone call in the history that I've ever taken in business."
"I did cartwheels down the hallway. At first I said, 'Is this a joke? Who are you?' Not understanding what an opportunity. And so we're just going to keep running them and running them and running them."
In June, Apple introduced 13-inch MacBook Pros for $100 less than the MacBooks they replaced and cut $300 off 15-inch and 17-inch laptops. Assuming the story is factual as told, Apple legal actually has a point about the price comparisons in most "Laptop Hunters" commercials. That said, the prices were correct when Microsoft first aired the ads.
Is there a little tit for tat going on here? Of course. I had noticed that in recent weeks Microsoft started airing older Laptop Hunters commercials more frequently, after a hiatus. I didn't make the connection until today that these same commercials also call out the higher Mac notebook prices.
Is that unfair? In marketing there is no love between competitors. Just war. Microsoft took the marketing two-by-four to Apple's head. Whack. Whack. That's what effective marketing is for.
It's no wonder Kevin Turner cartwheeled around the office. For nearly three years prior to Laptop Hunters, Apple dominated PC purchasing messaging with "Get a Mac" commercials, which brilliantly use two people -- Mac and PC -- to simply communicate complex ideas about computer buying. KT told Microsoft partners about reactions a year ago:
"Gosh, when I went home for the holidays, brothers, sisters, cousins -- hey, hope you don't have anything to do with marketing over there at Microsoft. What are you guys going to do about those Apple ads?"
Apple and Microsoft are both readying new operating systems for autumn release. I expect Microsoft to all but literally cover the planet in advertising. According to KT:
"When we put Windows 7 in there, which we've got coming out in October, what an incredible opportunity for us to fight back. And it feels really good to be on the offensive here. And we know we've got plenty of work to do. We don't have it all figured out."
Laptop Hunters commercials have proved to be a surprisingly effective response to Apple marketing. "I'm a PC" ads were OK and "The Rookies" spots were much better. The Laptop Hunters series is the big home run. The commercials have improved perceptions about Microsoft and Windows PCs. The company stated so during its earnings call three months ago. By the way, the Bing commercials are even better -- some of best tech ever run on TV.
I suspect Apple's sensitivity is more than about Laptop Hunters. Microsoft has played up value by highlighting what it calls the "Apple Tax" -- the price premium paid for Macs compared to Windows PCs. In fairness to Apple, that premium is in the market under $999, which is the entry price to join the iMac, MacBook Pro or Mac Pro clubs.
Microsoft plans to expand the "Tax" concept. Apple is one target. VMware is another. Kevin Turner told Microsoft partners: "Just like we did with Apple...we're going to get this virtualization tax, the VMware tax out there and start driving people crazy with the value proposition."
Given the econolypse, Microsoft has picked a good time to reemphasize value in its marketing.

~Simple Truth~
MS = bloaty, me-too, half-baked software with an expensive long-term TCO. Generally cheaply made and poorly designed hardware with a short life - replace every 2-3 years. End result -> $$$, landfill, and many headaches along the way.
Apple = Classy well-running OS. Excellent and useful quality software included. Top-of-the-class hardware that runs both its own OS (and even Windoze if you must) wonderfully. Replace every 4-5 years after years of enjoyment and maybe even make a buck on the sale. End result -> $$ and :)

|Because Apple has historically been the underdog, people generally overlook how low-class and cutthroat they can be. After reading any sort of Mac publication, it's refreshing to go pick up a PC, gaming, art, etc magazine and actually read them talk about their products instead of spend half the article space trash talking others. The Apple brood can't get a sentence out without sinking to new lows.
I congratulate Apple on it's design achievements. But I'd have to be blind and, well, dead not to see how they are as bad or worse as any other company out there. But only a heretic would admit that, I guess....

Good design and quality products have little to do with it.
Their DAPs are the poster child for poorly designed, planned obsolescence garbage. Their laptops are another example of overpriced false elitism. In fact it has been my observation over the last twenty years that you can always count on Apple for overpriced, underpowered products with blazing hype. "Value for dollar" and "Apple" are mutually exclusive terms, cult fanaticism aside.

Because a lot has happened with Apple in the last decade or so, including being one of the most successful and innovative tech company in the world, winning countless awards for best design and being the most admired company in the US (America's Most Admired Companies 2008 - Fortune magazine) and, of course, let's not forget topping all customer satisfaction surveys.
Clearly, I think the quality of their design has got to be worth something, don't you think?

To revisit the iPhone comments from below. I think it's funny that Apple teamed up with the worst phone service in the world and the biggest Microsoft clone AT&T.
I hope they get smart and do not renew their contract. Not that I want an iPhone but because I think... The decision to go with AT&T was another one of those bad decisions that is holding Apple back. Maybe Apple would have a bigger share of the market if they quit "Micro Managing" everyone that wants to jump on the "Apple Band Wagon".
It's kind of like prejudice. My family moved to the US in 1910. I'm proud of my Italian heritage but I don't go around referring to myself as Italian American all the time. Maybe we would have less fighting and prejudice if everyone just accepted that they are Earthlings and left it at that instead of rubbing it in everyone's face all the time.
Yes my last comment had nothing to do with this post but since I have the audience I'll use it and hopefully it will open someone's eyes. My brother in law and boss are proud of their heritage too but they don't dwell on the pains of their ancestors. They strive to better themselves, just like our president.

|I was with Rodime in the early 80's when we manufactured hard drives for the macintosh. it was clearly a better product than the X86 at that time. Steve Jobs shot himself in the foot by being too proprietary then and it looks like he is back and doing it again. Apple finally woke up and went to intel but Jobs will soon run the iphone into the ground. Technology is advancing too fast to remain proprietary and let someone else pass you. Frankly Apple doesn't have enough technical people to remain on top.

|hell... everytime i read comments after M$ Windoze vs. Mac articles, everytime i get convinced more and more that not the windoze guys/gals are ignorant, but actualy apple worshipers are. i do hate religious wars (and these coments are nothing less) between worshipers of various OS, and can say one thing to MAC'en'trash worshipers: stay quiet, and don't say a word about how it's good to use OSX, because viruses and malware actualy is nothing less than indicator how popular the OS, that's being targeted, is. no one is going to write a virus for some unused platform, simply because it is a waist of time (and money). So don't wanna deal with mallware, don't raise a number of MAC users. And one more thing. I've tried MAC and well... actualy it's s***. I love PC platform mostly because it's open, not like mac is. and no, i do not use windows for everyday tasks, yet it's great os, and more open to hardware than OSX is, i'm a linux guy so sorry, but not every PC guy is Windows worshiper. the whole good thing about variety is the fact that you can choose what's best for you, or the specific task that you are working on. so please stop those stupid holy wars. peace V

|Well the theory that Macs cannot get viruses /spywares/malwares is actually a myth. If not there would not have been antiviruses for Macs in the market. including Macafee and Symantec. Yes they are less because % of Windows users far outnumber % of Mac users .

|Religious wars on PCs. Ordinarily I'd say the war was limited to @home zealots, but companies engage in this a well. They "pick" software oftentimes because it is or isn't from Microsoft. There might be something to not being 100% MS - I'm not sure. What I do know is I've programmed on many many plkatforms. The early Macs had a very fun development environment. Course the "apps" was what made it the best "app" I've ever worked on. That said, it actually doesn't matter what hardware is better or what OS is better (assumning cost and other factors are not completely out of bounds from each other). I believe OS/2 was better than Windows. I believe Macs have (or had) the best graphics. It doesn't matter. To make my point before stating my point, I took a college course in database technology after I had 10 years experience in mostly Big Blue Big Iron technologies. Big question on the final was "what is the best database technology today and why". I wrote IBM IMS because that is where the money is. Got that question correct. It didn't matter the soundness of the technology, what was technically better or vastly cheaper. If you knew IBM IMS you got a great paying job just about anywhere. You could be a zealot and use another vendor that might have been cheaper to purchase, maintain, use, any metric you want, but if only 3 university shops in different states use it, and evewn if they pay top dollar - what's the point? MS currently has what is called global dominance in "market share". If you want to exchange documents on the internet or between home and work in most companies you use the MS Office document formats. Open source products match the formats the dominance is so great. And that is a good thing. That is what everyone cryed for when all Mac softeware behaved the same. So MS did same thing LIKE EVERYONE WANTED (well, except Apple), and now software more or less behaves the same. Same is true for programming languages. Sure some are demonstratably better than others. Some have real world legacy issue to hang around. Some only stay around because the lead developer on a project knows "x" so "x" is what will be used. If they use "y", well, he/she is no longer a subject matter expert. And lotys of folks made their choice on PC or Mac long ago and do not want the hassle and expense of rebuying everything to convert, so whatever choice they made whenever makes what they have now in whatever upgraded form "the best". Nothing is "the best" in all categories and year in year out. The only outdated concept here is that there are still folks so pigheaded as to keep this religious war going. It is over - the market place said so. And over time it will change. Big Blue learned that lession hard.

|I'm not sure if it's true or not but I was always under the impression that the virus writers were MAC owners. They couldn't overthrow the "Microsoft Government" so they used terrorist tactics.

|I attempted to modify the system to make it equivelent to what I'm currently running. They didn't have some of the things I do to ad them, so I just got as close as I could and left out adding any extra's. The price now is at 6248 for a computer that I personally built for 1000$
now were up to a 5000$+ apple tax
Someone was talking about having money to spend. if your spending this kind of money for an inferior product you just have more money then brains. *by inferior, I am speaking of the hardware, they don't even have the high end stuff available, the cpus are outdated models, same deal with video cards.

also for the price you're paying, i'd expect a warranty to cover anything, including accidental damage

|I'm a PC Tech. I've been in the business for 20+ years and I've used both MAC and Wintel. I simply prefer the Microsoft OS model. There's nothing else to it. I know Apple and Microsoft users and they all say great things about their systems. I'll have to say, and this is to JinkWelby@hotmail.com as well, that if asked, the only reason that I recommend that they buy their kids Windows machines is that Apple is not used in Business in the same quantity as Windows. Plain and simple. The kids of today need to know the OS being used in business so they can succeed. Nothing more, nothing less. I know the value of OSX, because I have used it. I know that it is used more by artists than Windows. I really like the music writing software on OSX than compared to Windows. But OSX gets beaten as a business machine. If you have proper protection and educated users, you don't get viruses on Windows. Gone are the days of Script Kiddie viruses taking down entire servers for hours. You don't hear about the next Melissa virus because hackers are too busy trying to figure out the next social engineering phishing scheme they can come up with. Sure you'll have families come down with viruses, but that's because they're not as educated as they should be. Honestly, feature for feature, OSX and Windows are near on par. It's just a matter of what is used in the business world and what isn't.

|I'm not saying anyone who likes a PC is ignorant. I'm saying that sometimes you get what you pay for - and in the case of Apple-OSX / PC-Windoze, I think the "Apple-tax" baloney is just that. I'm writing this response in XP on my MacBook Pro because because my job demands I use SQL Server \ Visual Studio. .Net is some nice technology stolen from Delphi and Java but is quickly becoming the usual MS Juggernaut... but I digress.
Firstly, I had to toss Vista off of here because of lousy performance with some of the software I'm forced to use. Nice waste of time and money that was - Vista was not cheap for the Business version either (MS Tax). And now they expect me to pony up a big junk of change for Vista SP3 (W7). Hmmm.
Secondly, this MacBookPro is the best windoze laptop I've ever had - looks great, performs great, feels great, weighs great. I'll be happy with it for years and still get a more reasonable buck for it when I'm done.
Thirdly and finally, whenever I'm not forced to use winware, I boot into OSX. What a difference - a beautiful, spry and polished GUI and "built-in" software that are a pleasure to look at and to use. A wonderful OS to "dive deeply into" as well with it's Unix under-pinnings. It makes me feel more creative, light, and I have more fun being productive when I'm there. And Apple's next version of OSX - which is focused almost purely on even more polish and performance (brilliant!) and not just a bunch of fixes, feature creep, and some makeup (W7) - will only cost 30$.
The Apple Tax quickly becomes the Apple Tax Rebate when you really start to get down to it.
I may still have to use Windoze sometimes but I am no longer a "Windows Hypnotard". I have woken up and I hope MS does too and comes up with an OS that doesn't feel so much like a Pinto trying to fool us with a Porsche paint job and price tag to boot.

I am an image editor and 3d designer, from autocad/autodesk 2d to full
on 3d I use a ton of differnt tools for image edition and designe, I tweak them all for my needs.
I have looked for mac tweak websites. not very impressed with the results.
See if you limit the world to one button one design, you limit creativity and growth.
The world can not live on just what you have been taught, you have to stumble into things
and learn things, along with getting taught. Meaning you can not grow with th theory of
"it just works". Why does it work, how does it work, how can i make it better? what can I add to it
how can I make it work better for my specific need. Should we all take a mac class and
putting on our riding crops and blinders and stay in our cubicles and never peak out
to see how someone else does things?
My opinion, apple is the nazi of operating systems and software.
They throw a tantrum if you release their leaked info.
They only want their o/s on their machines.

|TruxTer - you didn't read my full post obviously. OS X is deep - much more fun to tinker with then the Windows child-like DOS underpinnings. I'm a developer and I prefer X Tools to C# though I do admire some of the Delphi/Java tech M$ stole for C# and the IL (not to mention the Delphi engineer who is the mastermind behind it).
Anyhow, Apple has to be secretive for a number of reasons - one of which is that Microsoft tries to steal virtually every idea and bribe away every engineer they have. This is what the "must buy Microsoft because they are the most prevalent" "I'm a PC clone because everyone else is" Fear Types get for supporting the company that has been sued for anti-competitive behavior more than any other company in the history of the world. Wake-up!

I don't hate MACs, I just love my PC and wouldn't give it up for anything. As for Blista or Windows 7. I hate the fact that Windows 7 forces us to use that Crappy MAC style interface. I prefer the straight forward classic Windows 98 start menu. It's easy and efficient.

If Apple is so good then how come they can't beat the PC? Even Pixar uses the PC to process their films. They may use the MAC to create the film but it's the PC that encodes and converts the final product.

|These ads are going to have some effect in the market, but they are also going to help Apple's "premium brand" cred. They are entirely focused on price, and cheapskates aren't cool.
While I'd argue that the "Apple Tax" is actually fairly small, since they are very high spec machines, some people will continue to believe it is big. And to them, someone having an Apple shows that they can afford to pay it for a premium product and brand. Heck, if you buy anything but generic K-Mart clothing, you are probably paying a "Tax" that is 100X higher than the "Apple Tax".

|Uh...Macs are PCs, so probably talking any common sense to you is above and beyond pointless but here goes.
The only difference from a Wintel box and a Mac is the OS, all the internal components are made by the same manufacturers that make wintel parts. The difference is apple uses a trusting computing module to prevent all hardware from working on it (except specific brands) and uses efi instead of bios.
Macs can get viruses it just won't affect them but you can pass it onto your windows buddies, so again you are clueless.

This is an important point, because, to any one with a functioning brain, WIndows has only ever been 'better' than Mac in one way--more software.

I'm not sure how you justify any of your BS about the software because that has always been the weak point of the Macintosh. The software available on the market for Mac is about 1/2 or 1/3 of that available for the PC (Windows) market.
Just go to your local software store, or best buy. You can clearly see the difference.

The zune is a great device and has a much more intuitive gui but they came late to the party and released features for the device 3 yrs too late.

They do the "I'm a Mac/I'm a PC" ads, basically putting down Windows, and then complain when Microsft comes out with thier own ads, showing that a Windows PC is cheaper.
As for "fatty's" suposed Microsoft Tax, any PC user worth thier salt will stay away from the stupid Fire Dog or Geek squad type support. It is a waste of money for anyone. The point is that for the majority of people (those not using Illustrator and Photoshop), they can get what they need for what they do *cheaper* by not going the Apple route.

I bought one and have to say it's paid for itself in spades compared to the virus messes and general instability/complexities/headaches and just plain breakdowns and poor performance dealing with the ancient windows architecture.

|Same here, I run at home and at work.
It's a very stable OS, with few problems besides being bloated. Windows 7 will streamline the OS and refine some key problems.
We have it on around 200 machines, and I support them with very few issues.
I didn't like the following about vista:
Some of the control panel applets were made much more difficult (networking) and were a step back in ease of use
With the introduction of UAC they removed the "Run as" another user option, I found power tool to do this.
Deploying Vista from an imaging perspective is pretty nice because of the separation of the hardware layer, but they also changed quite a few things which made it more difficult.
